SCOTUS Discuss Bans on Transgender Teens

With the New Year approaching, it is common that we reflect on what has happened in this past year and compare said events with years prior. The percentage of adults who identify as transgender has increased by 68% since 2014. With this growth comes many discussions.

Recently, the SCOTUS heard arguments on the constitutionality of Tennessee’s 2023 ban on gender-affirming treatments for minors, including puberty blockers and hormone therapies. Plaintiffs, including families of transgender teens and the Biden administration, argued the law discriminates based on sex under the 14th Amendment, as it prohibits such treatments for gender dysphoria while allowing them for other conditions. However, Tennessee defended the law as nondiscriminatory, asserting it applies to both sexes equally and is aimed at protecting minors from irreversible decisions.

With compelling arguments on both sides, the justices seemed divided– especially clear with Justice Neil Gorsuch’s silence and Justice Amy Coney Barrett’s probing questions, which left their positions unclear. The liberal justices expressed concern over denying necessary treatments, while conservative justices focused on states’ authority and medical uncertainties.

This case comes amid broader debates on transgender rights, as Republican-led states increasingly impose restrictions. The Court’s ruling, expected by July, could set a significant precedent for transgender rights and state powers over healthcare policies. As a result of this decision, public policies could be impacted heavily. Policymakers might use the decision to craft more detailed legislation clarifying the scope of medical treatments allowed for minors, potentially requiring stricter oversight or age-based consent measures. Alternatively, a decision striking down the ban could prompt states to reevaluate existing laws and prioritize inclusive healthcare frameworks that balance medical ethics with individual rights. This case could also inspire federal guidelines on gender-affirming care, creating uniformity amid a patchwork of state laws.
